Definitions 1.1 ‘Agreement’ – these terms and conditions and the Booking Confirmation. 1.2 ‘Company’ – Wolverhampton Education Centre Limited (registered as a company in England and Wales, with company number 14102510). 1.3 ‘Child’ – the child who is registered to attend a GCSE Intensive Revision Course(s). 1.4 ‘Customer’ – the parent/guardian/carer of a child registered to attend a GCSE Intensive Revision Course(s), named on the Booking Confirmation. 1.5 ‘Syllabus’ – the Course syllabus appended to this Agreement. 2. Basis of the contract 2.1 The Company agrees to provide GCSE Intensive Revision Course(s) as described in the Booking Confirmation and in any GCSE Revision Course(s) description contained in any current brochure or other material of the Company from which the Customer made the booking, and the Customer agrees to pay the Course Fee in accordance with the terms of this Agreement. 2.2 These terms and conditions shall apply to the exclusion of all other terms and conditions. 2.3 The Company may assign this Agreement and may employ sub-contractors and third-party training providers to carry out any part of its obligations under the Agreement at its sole discretion. 2.4 Any variation of these terms and conditions shall be inapplicable unless agreed in writing by the Company. 2.4.1 Any quotation submitted by the Company shall be subject to these terms and conditions. 3. Payment Provisions 3.1 The Company reserves the right at any time before the start date of a GCSE Revision Course(s) to increase the GCSE Revision Course(s) fee if: 3.1.1 The costs to the Company of providing any facilities increase due to market forces or any factor beyond the control of the Company; 3.1.2 The Course details are changed at the request of the Customer or by the Company in accordance with clauses 5 and 6; 3.1.3 Such changes will be notified to the Customer in writing and the Customer shall have 7 days from the receipt of such notice to cancel this Agreement. 4. The Customer shall pay: 4.1.1 A payment of 100% of total GCSE Revision Course(s) fees in order to secure a place on the preferred Course(s) date. 4.2 The Course(s) Fee includes VAT which shall also be charged at the current rate. It excludes (except where stated on the Booking Confirmation). 4.3 The company accepts the following forms of payment: 4.3.1 Cash. 4.3.2 Bank transfer. 5. Cancellation and Amendment of Course(s) Date(s) by the Customer 5.1 In the event that the Customer cancels the Course(s) after the 30-day cancellation period and provides less than 30 days’ notice of cancellation before the Course(s) start then 100% of the fee will be forfeit. 5.1.1 Once the Course(s) has commenced there will be no refund of Course(s) fee in the event that the Customer chooses to leave. The Customer’s statutory rights are protected at all times. 5.1.2 Termination of this Agreement shall not affect any rights of the parties accrued to them up to the date of termination. 5.2 If a parent wants to change a Course(s) they must request this by emailing the Company on admissions@exceltuition.net, at least 7 days in advance of the original Course(s) date. The request will be subject to availability. If there is no availability, the normal cancellation rules will apply. 6. Cancellation and Amendment by the Company 6.1 The Company reserves the right to cancel this Agreement with immediate effect if: 6.1.1 In the event that the Course(s) is undersubscribed. 6.1.2 In the event that the Customer wishes to cancel their Course(s) attendance they must do so within 30 days of the date shown on this Agreement. Notification of cancellation must be made in writing by email to admissions@exceltuition.net. Upon receipt of any such notice any funds paid by the Customer will be refunded in full. 6.2 From time to time and to accord with those requirements the contents of any brochure or other material including pricing details and the content of Course(s) may be varied by the Company at any time without notice to include deductions and additions to the Syllabus. 6.3 To change or substitute any part of the Booking Confirmation or the content of the Syllabus or the Course(s) at any time and will notify the Customer in writing of the same. The Company will use its best endeavours to ensure that any alternative arrangements are of at least comparable quality and function. 7. Safety 7.1 The Customer shall ensure that they or the person responsible for dropping off and picking up the Child to and from the GCSE Intensive Revision Course(s) location on the session date shall: 7.1.1 Drop off the Child to the supervision of the member of staff responsible for the Child’s Course(s) at the beginning of the session when the room is opened and not before; and 7.1.2 Collect the Child from the member of staff responsible for the Child’s Course(s) at the end of the session from the room as requested at the end of the examination and/or course. 8. Medical conditions, Medications and Treatments 8.1 At the point of registration, the Customer shall inform the Company if the Child has or suffers from any medical injury, condition (including any allergies) or disability that ought to be brought to the attention of the Company so that an assessment of the Child’s needs can be properly made. In the event that a Child suffers from a medical injury or condition that could require physical intervention at any time, the Customer will be required to remain in the building for the duration of the Course(s). 8.2 If the Company is informed that a Child attending a Course(s) has an allergy, the member of staff will, if specifically instructed by the Customer, take reasonable precautions to protect that Child from exposure to the cause of the allergy, but the Company cannot guarantee non-exposure. In the event that a Child has an allergy that could require physical intervention at any time, such as the use of an EpiPen or other medication, the Customer will be required to remain in the building for the duration of the Course(s). 9. Complaints Procedure In the event of a complaint the Customer must write in to explain the precise nature of the complaint as soon as it is apparent. This will be investigated in accordance with the Company’s complaints procedure and a letter of explanation with any suggested remedy, if appropriate, will be provided at the end of that investigation. 10. Miscellaneous 10.1 The Company retains ownership of copyright and all other intellectual property rights to all material produced in or used for the Course(s). 10.2 This Agreement is the complete and exclusive statement of the agreement between the parties relating to the subject matter of the Agreement and supersedes all previous communications, representations and other arrangements, written or oral. 10.3 If any part of this Agreement is found by a court or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from the remainder of this Agreement which will continue to be valid and enforceable to the fullest extent permitted by law. 10.4 This Agreement will be construed in accordance with and governed by the law of England and Wales. 11. Data Protection 11.1. Personal data that you give us will be used to: 11.1.1 Provide the GCSE Intensive Revise Course(s). 11.1.2 Contact the Customer from time to time with details of courses, which may be of interest to them. 11.1.3 We may store personal data in hard or electronic format, and it may be accessed by other companies within the Company Group. We will not give, or provide access to, any personal data to any third party. The Customer may object in writing if they do not wish to receive such material.
